Terms and ConditionsEffective Date: 18 June 2026Welcome to my website, matteobardari.com. My name is Matteo Bardari, and I offer professional audio mixing and mastering services. Below you'll find the terms and conditions ("Terms") that govern the use of my website and services. By accessing or using my website and services, you agree to be bound by these Terms.These Terms apply both to clients acting as consumers (natural persons acting for purposes outside their trade, business, craft or profession) and to clients acting as business clients (acting within their professional or business activity, e.g. with a VAT number). Some clauses apply only to consumers and are marked accordingly. Where the law grants consumers mandatory rights, nothing in these Terms limits or excludes those rights.1. ServicesI provide professional mixing and mastering services ("Services"). The specifics of these Services are detailed on my website and, where applicable, in the individual quote agreed with you. By using my Services, you agree to the following:- Service Requests: You must provide accurate and complete information when requesting my Services.
- Quotes and scope: The scope, deliverables, and price of each project are defined in the quote I send you (often via a personalized payment link). The quote, once accepted, together with these Terms, forms our agreement.
- Delivery: I will deliver the mastered audio files within the timeframe indicated in the quote (typically 3–4 business days), but this may vary depending on my workload and other factors. I will inform you of any material delay.
- Revisions: For mastering, you are entitled to a reasonable number of revisions. For mixing, the number of revisions included in the price is agreed in advance in the quote. You can modify the mix only once after mastering; subsequent modifications will be charged at the applicable rate.2. PaymentsAll fees for my Services are as stated on the website or in the applicable quote. Payments must be made through my designated payment methods. By providing payment information, you confirm that you are authorized to use the chosen payment method and that you authorize me (or my third-party payment processor, e.g. Stripe) to charge that method for the total amount due, including any applicable taxes and charges.Fees are non-refundable once the Services have been fully performed, except where a refund is required by mandatory law or by the right of withdrawal described in Section 3 below. Nothing in this Section limits the mandatory rights of clients acting as consumers.3. Right of Withdrawal (Consumers only)This Section applies only if you are acting as a consumer. It does not apply to business clients.General rule. As a consumer entering into a distance contract, you generally have the right to withdraw within 14 days, without giving any reason, under the Italian Consumer Code (D.Lgs. 206/2005).Exception for custom and personalized work. My Services consist of audio work created to your specifications and clearly personalized for your project, and of services that I begin performing on your request. Under Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to:- the supply of goods/works made to the consumer's specifications or clearly personalized;
- services fully performed, where performance began with your express prior consent and your acknowledgment that you will lose the right of withdrawal once the contract has been fully performed;
- digital content not supplied on a tangible medium, where performance began with your express prior consent, your acknowledgment of the loss of the right of withdrawal, and my confirmation.Your consent. Because each project is personalized and you typically want work to start immediately, before I begin I will ask you to expressly request that I start performing the Services before the end of the 14-day withdrawal period, and to acknowledge that, as the work is personalized and/or once it is fully performed, you lose your right of withdrawal. This consent is given when you accept the quote and proceed with payment, where the order flow expressly states the above. Until you have given this consent and I have started work, you keep your 14-day right of withdrawal and may exercise it by an unequivocal statement (e.g. an email to [email protected]). In that case I will refund the amounts received without undue delay.Withdrawal function. Where the right of withdrawal applies, you may exercise it by contacting me at [email protected]. Because my Services are personalized and started on your express request, the withdrawal right typically does not apply once work has begun.4. Intellectual PropertyAll content on my website, including text, graphics, logos, images, audio clips, and software, is my property or that of my content suppliers and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works of my content without my express written permission.Upon full payment, you retain all rights in your own musical works and recordings. The mastered/mixed deliverables I produce for you are licensed/transferred to you as agreed in the quote.5. - Engage in any conduct that could harm, disable, overburden, or impair my website or interfere with any other party's use of it.
- Upload or transmit any material that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.7. TerminationI may suspend or terminate your access to my website and Services if you breach these Terms or applicable law, or to comply with a legal obligation.For business clients, I may also terminate or suspend access at any time, without prior notice, for legitimate reasons. For consumers, any termination or suspension will be carried out in good faith, with reasonable notice where required by law, and without prejudice to your mandatory rights and to Services already paid for and not yet delivered.8. Disclaimers and Limitation of LiabilityMy website is provided "as is" and "as available," without warranties of any kind as to uninterrupted or error-free operation, to the extent permitted by law.To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from your use of (or inability to use) my website.Consumers: nothing in this Section excludes or limits my liability where such exclusion or limitation would be unlawful. In particular, I do not exclude or limit liability for death or personal injury caused by my negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any mandatory statutory rights, including the legal guarantee of conformity for the Services provided.9. Dispute Resolution and Governing LawI am always available to resolve any complaint amicably; you can contact me at [email protected].If we cannot resolve a dispute amicably, consumers may turn to an alternative dispute resolution (ADR) body. The European Commission's ODR platform was discontinued on 20 July 2025 and is no longer available, so no ODR link is provided. The list of certified consumer ADR bodies is published by the competent authorities (in Italy, the Ministero delle Imprese e del Made in Italy).These Terms and any disputes relating to them or to my website/Services are governed by the laws of Italy, without giving effect to conflict-of-law principles. For consumers: this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of your place of residence where the law so provides.10. Changes to TermsI reserve the right to modify these Terms. I will notify you of any changes by posting the updated Terms on my website, indicating the new effective date.
